Unfortunately, litigation is not like anything you see on TV where you come in and see a lawyer and your trial is two weeks later. In New Jersey, the typical length of a case can be anywhere between two-and-a-half to four years. However, through various periods of time, we are in constant contact with the insurance company to see whether or not your case is resolved. Part of why it takes so long for a case to come to trial is because of the time it takes to gather your medical records, investigate the scene of your accident, talk to witnesses, and also get expert testimony, which is required in the state of New Jersey for your case to be heard. There are also some occasions in which the insurance company does not want to settle and you may have to go to court. Every situation is different and therefore we have to take a look at each case individually to determine the steps that need to be taken in order to proceed with your case. We will need to know the extent of your injuries and how long it will take to treat them. You may have to have surgery or go through a physical therapy rehabilitation program, which can take months on its own. Your injuries may, unfortunately, worsen down the road and unforeseen surgeries or rehabilitation may have to occur that could never have been predicted at the time you filed your case.
